Defending Against Safety Claims

A number of industries are at high risk for workplace injuries. Businesses engaged in manufacturing, agriculture and construction are more likely than others to experience workplace safety claims. It is important for supervisors and managers to be able to protect their employees from injury, and the company from claims.

Employers have an obligation to ensure a safe work environment. In recent years, there has been a marked increase in the number of occupational safety and health regulations (both federal and state), that employers must comply with, along with enhanced civil and criminal penalties.

Mr. Wilson assists clients by:

  • Advising on the application of, and compliance with, Federal and State OSHA standards;
  • Advising and representing clients in response to OSHA inspections;
  • Representing employers in OSHA litigation; and
  • Preparing or reviewing written safety programs, standard operating procedures, workplace safety rules, and employee handbooks for compliance with state and federal statutes.

Workplace safety is a major concern for employers; especially those in high risk industries.

He advises clients on the state-required Injury and Illness Prevention Program for their employees. Investigating and defending against claims

Even after extensive training and preventive actions, workplace safety and workers’ compensation claims occur. If investigation reveals that a claim is valid, he works with clients to prevent such claims in the future.
